In a lawsuit filed on 1/20 in the United States District Court of New Jersey, WWE and ABC Corps 1-10, Inc. were served with a lawsuit alleging that WWE textbook covers featuring images of DX, Shawn Michaels, John Cena, Triple H, CM Punk, Rey Mysterio, Edge and others infringed upon and violated Turtle's patent for "Adjustable book jackets" and their "method" for making said book jackets.
ABC Corps. licensed WWE's characters for the textbook covers.
The lawsuit suggests that The Turtle Company has been damaged by the production of the items and will continue to be damaged.
The lawsuit demands that an injunction be issued to prevent the continued production of the textbook covers, that the defendants account for all damages made to Turtle, that Turtle be awarded "the maximum rate allowable by law" for pre and post-judgment interest to those damages and that Turtle's attorney's fees be covered by the defendants.
Turtle have asked for a jury trial in the matter. WWE and ABC are required to respond by 3/13.
